NDAA – National Defense Authorization
This week, a 2-time war veteran marine was thrown in a mental hospital for a Facebook post. This injustice is demonstrative of the erosion of civil liberties and freedom in America.
If you haven’t yet – (read the first post here) for the full story.
Was Brandon Raub arrested under NDAA?
First – a briefing of what the National Defense Authorization Act (NDAA) really is, and why if you are an American, this is the most constitutionally infringing piece of legislature ever passed in the history of America; a sign of the times and a signal to leave.
Let’s examine the actual act – specifically Title X, Subtitle D, Sec 1012:
Subtitle D – Counterterrorism
Sec. 1021. AFFIRMATION OF AUTHORITY OF THE ARMED FORCES OF THE UNITED STATES TO DETAIN COVERED PERSONS PURSUANT TO THE AUTHORIZATION FOR USE OF MILITARY FORCE.
(a) In General- Congress affirms that the authority of the President to use all necessary and appropriate force pursuant to the Authorization for Use of Military Force (Public Law 107-40; 50 U.S.C. 1541 note) includes the authority for the Armed Forces of the United States to detain covered persons (as defined in subsection (b)) pending disposition under the law of war.
(b) Covered Persons – A covered person under this section is any person as follows:
(1) A person who planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored those responsible for those attacks.
(2) A person who was a part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces.
Essentially – if the government deems that you are a “covered person” who has committed a “belligerent act” you can be thrown in jail (or a psych ward) indefinitely. With no habeas corpus. No right to trial. No rights as an American citizen, bestowed upon you in the bill of rights.
Is NDAA even legal?
After questioning whether Raub was arrested under NDAA the other day, I still maintain that he was not arrested under NDAA. I may at some point have to redact that statement – if he spends a minute over 30 days of confinement in a mental institution.
I say Brandon was not arrested under NDAA because under state law of Virginia if:
a) A person goes before a judge and says that you might hurt someone or yourself due to mental instability and
b) The magistrate decides to send the police out to pick you up and transport you to a hospital for evaluation.
c) You will have a court proceeding and
d) You can be detained for up to 30 days.
This is not NDAA, this is a state law in Virginia – and actually quite common.
Was Brandon Raub arrested under NDAA?
At this point, it appears not. He has already seen a judge, for one. However, the key to determining if Brandon Raub was indeed arrested under NDAA hinges on how long he is detained against his will in the psychiatric ward. Some may argue the point of establishing whether it is “technically” NDAA matters, but here’s the important point:
In court proceedings against NDAA, federal judge Kathleen Forrest created a court order against the unconstitutional NDAA Sections 1021 and 1022, essentially declaring them illegal. If Raub was arrested under NDAA, the US Government is in criminal contempt of court.
Let’s not get caught up in semantics about NDAA – the point of the story here is that this is the type of imprisonment for freedom of expression is simply unacceptable. Mr. John W. Whitehead, president of The Rutherford Institute (and the lawyers who represent Raub) stated this point eloquently:
“For government officials to not only arrest Brandon Raub for doing nothing more than exercising his First Amendment rights but to actually force him to undergo psychological evaluations and detain him against his will goes against every constitutional principle this country was founded upon. This should be a wake-up call to Americans that the police state is here“

What did Brandon Raub post that got him locked in a mental hospital?
This is the post that caused international uproar.
America has lost itself. We have lost who we truly are. This is the land of the free and the home of the brave. This is the land of Thomas Jefferson. This is the land of Benjamin Franklin. This is the land of Fredrick Douglas. This is the land of Smedley Butler. This is the land John F. Kennedy. This is the land of Martin Luther King. This is the land where the cowboy wins. This is the land where you can start from the bottom and get to the top. This is the land where regardless of you race and ethnicity you can suceed and build a better life for you and your family. This is the land where every race coexists peacefully. This is the land where justice wins. This is the land where liberty dwells. This is the land where freedom reigns. This is the land where we help the poor, and people help eachother. This is land where people beat racism.
The federal reserve is wrong. They have designed a system based off of gread and fear. They designed a system to crush the middle class between taxes and inflation. This is wrong, and it is unjust. It is wrong.
We have allowed ourselves to be devieced and seduced by the powers of the printing press. It is not a good system. It discourages saving: the foundation for all stable economic activity. The federal reserve is artificially manipulating interests rates and creating phony economic data. This thing has decieved our entire nation.
They created it 1913. They also created the income tax in 1913. They encouraged the growth of debt so they can tax you on it. There is interest on the debt. Your government is in bed with these people. They want to enslave you to the government so that they can control every aspect of your lives. It is an empire based on lies. They operate of greed and fear.
There is a better way. It’s called freedom. Freedom is called a lot of things. But there is a true meaning. It means very simply that you have the right to do whatever you want as long as you are not infringing on the feedoms of other people…
Arrested For Facebook Posts.
On August 20, in a hearing before Justice Stokes, government officials stated Brandon’s Facebook posts were the sole reason for his detention in a psych ward. His involuntary admission to Veterans Hospital in Salem – 3 hours away from his family is because of Facebook posts.
Maybe you think what he says is crazy. Let’s say for sake of argument, we agree.
Now let me ask you this: do you accept the fact that your freedom of expression gets you handcuffed in front of your neighbors, and thrown in a psych ward against your will?
2 takeaways:
- You are being watched. Your Facebook and Twitter posts, and your phone calls and emails are being monitored. Your privacy is gone.
- The United States is a police state. You are not safe unless you are an obedient debt servant. Your freedom is gone.
This is unbelievable.
It’s appalling.
It makes me angry.
Are you angry about this?
Are you mad enough to do something about this? Do you have the guts to forward this to friends or family to let them see what is happening in America?
